Under the FCC Rules, the determination of whether a wireless facility will impact historic sites [47 CFR Section 1.1307(a)(4)] requires that all applicants, licensees, tower construction companies and their authorized representatives meet the provisions of the National Historic Preservation Act (NHPA) under 36 CFR 800, "Protection of Historic Properties." These regulations implement the Section 106 review process, which requires licensees of wireless facilities to consider the effects of their actions on historic properties before the wireless facility is installed.
The Section 106 review process requires an exchange of information and opinions between consulting parties that have regulatory responsibilities, including the applicants, local governments, and State or Tribal Historic Preservation Officers.
