National Environmental Policy Act (NEPA) Checklist Report:  Ensuring Compliance Requirements

The purpose of performing a NEPA checklist report is to determine whether a proposed action will affect any of the "sensitive areas" identified in Section 1.1307 of the FCC Wireless Telecommunications Bureau - Rules & Regulations.  By preparing NEPA checklist reports and environmental assessments, EBI Consulting ensures that compliance requirements under NEPA are met.

The NEPA checklist report includes a summary of EBI Consulting's research, a statement of our findings, and hard copies of correspondence with all applicable agencies to determine whether the proposed action will affect any of the environmentally sensitive areas defined by NEPA. Specifically, the licensee must determine whether their proposed action will have a significant environmental effect on any of the environmentally sensitive categories defined in section 1.1307.

If the findings of the NEPA checklist report determine that the proposed action will not affect any of the "environmentally sensitive categories" defined in Section 1.1307, Section 1.1306 states that the licensee may proceed with the project without providing any documentation to the FCC. Both FCC Form 600 (Application for Mobile Radio Service Authorization) and FCC Form 854 (Application for Antenna Structure Registration) contain question 28, which asks whether the licensee's proposed action may have a significant environmental effect requiring an environmental assessment. If the licensee indicates "No" to this question, no environmental documentation is required to be filed with the FCC. However, in the event that the FCC pursuant to section 1.1307(d) requests such information, the licensee should maintain all pertinent records and be ready to provide documentation supporting its determination that an environmental assessment was not required for the site.
