Toxic Substances Control Act (TSCA) Compliance Services

Under the Toxic Substances Control Act (TSCA), you are required to manage and maintain records of certain chemicals that are processed or produced in your facility.

TSCA was enacted in 1976 to provide the United State Environmental Protection Agency (EPA) and the public with information about the potential health impacts of all chemicals. TSCA also allows the EPA to control production of, and in some cases even ban, certain industrial chemicals currently produced or imported into the United States that it believes might present a high risk for injury to human health or the environment.

TSCA has two primary elements:

  • Collection and submittal of information to EPA—companies are required to collect information about potential health impacts from worker exposure to chemicals. Information is provided to the EPA upon request by the agency. Companies must also provide information about known environmental, health and safety impacts of new chemicals being manufactured, including new intermediate chemicals in quantities above certain thresholds. Chemicals already registered under TSCA do not require this registration.
  • Regulating the production, distribution, use, and disposal of certain highly toxic chemicals, such as PCBs and asbestos.
